Terms & conditions
In short. The free audit is an automated, outside-only check: useful, but no guarantee. If we design a new website for you and you don't like it, you pay nothing. If you go ahead, the subscription costs €14.90 a month, paid per year in advance; it renews every year, and you can cancel at any time before the next renewal. Nothing changes on your website until you click Publish. You keep your domain, your content and your own responsibilities as website owner. If something goes wrong, our liability is limited to what you paid us in the last 12 months.

1. Who and what
These terms apply to the free website audit and to every proposal and agreement of Backend Lab, called "we" below. "You" is the person or business that asks for an audit or works with us. Other terms, such as your own purchase terms, don't apply unless we agree to them in writing.
Our services are meant for businesses. If you use them as a consumer, the mandatory rules of Dutch consumer law apply wherever they give you more rights than these terms — for example the right to cancel a distance contract within 14 days.
2. The free website audit
- What it is. An automated check of what anyone can see from the outside: security settings, privacy, speed, search engines, accessibility signals, DNS and e-mail settings. We don't break in, try passwords, log in or submit forms. It is not a penetration test, a security certification, legal advice, or proof that your website meets the law (such as the GDPR or accessibility rules).
- Only for your own website. You may only ask for an audit of a website you own or are responsible for. By asking, you confirm this and give us permission to run it. If you ask for someone else's website, you are responsible for that, not us.
- Results are indicative. The results come from automated tools and may contain mistakes or miss problems. You decide what to do with them. The audit is free, and as far as the law allows we accept no liability for it or for decisions based on it.
- Our choice. We may refuse or stop an audit at any time without giving a reason, and limit how often audits can be asked for. We keep the results, to compare later audits and to improve our tools.
3. Proposals and how you accept
- No cure, no pay. After a free audit, we may design a new website for you and send you a private preview of it with our proposal. If you don't like it, you pay nothing and have no obligation.
- How long a proposal is valid. A proposal is valid for 30 days unless it says otherwise.
- The preview is for you. Please don't publish or pass on the preview. If you don't go ahead, the design and the texts we wrote for it stay ours and you may not use them; what you gave us stays yours.
- Accepting. You accept through our onboarding form: you tick the box to accept these terms and our processing agreement, confirm that you have read our privacy statement, and pay the first year.
- When it starts. The agreement, and your first subscription year, start on the day we receive your first payment.
- For your business. If you accept on behalf of a business, you confirm that you may do so.
4. Prices and payment
- The price. The website subscription costs €14.90 per month, billed per year in advance: €178.80 a year. There is no design fee and no setup fee.
- VAT. Prices are in euros. Any VAT due is added to the invoice.
- Personal discounts. We may give you a personal discount (a coupon). It applies as your proposal or onboarding form states, and only for as long as stated there.
- How you pay. You pay the first year in the onboarding form, through our payment provider. There you also authorise us to collect each next year automatically on its renewal date. You get an invoice for every payment.
- Automatic renewal. The subscription renews automatically each year. You can cancel at any time before your next renewal date: see section 7.
- Late payment. If a payment fails, we let you know, and you then pay within 14 days. If you still don't pay, we may suspend your website until you do, and charge the statutory commercial interest and reasonable collection costs.
- Price changes. We may change our prices for a next year; we tell you at least two months before your renewal date, so you can cancel in time.
- Abuse or unfair use. If we see abuse or persistent unfair use, we may suspend or end your website's service at any time. We then refund the unused months and give you your data, so you can take it with you.
5. Hosting, changes and maintenance
The service
- What's included: the website we design for you; hosting on a global content delivery network; HTTPS certificates and their renewal; security headers; monitoring; off-site backups; visitor statistics, made from the network's access logs without cookies or tracking scripts on your website; your panel with its AI assistant; changes to your existing pages under fair use; and a version history.
- Availability. We keep the service reliable and watch it, but we can't promise a website is always online: maintenance and outages happen. There is no guaranteed uptime unless we agree one in writing.
- Speed. We guarantee a Google PageSpeed performance score of 95 or higher for your homepage, on mobile and on desktop, on the day your website first goes live. We check the score before we show you a design and again before launch. The guarantee is for launch day only: the score can drop later, for example through changes to your website or changes Google makes to how PageSpeed scores, and a lower score after launch is not covered.
- Backups are a safety net, not a guarantee. Keep your own copy of anything important.
- Storage and traffic are generous, but not unlimited. If your use goes far beyond what is normal for a small business website, we contact you first.
- Misuse. We may suspend or end a service straight away if it is used for anything illegal, harmful or that endangers our systems or other customers.
Changes through your panel
- How it works. You sign in to your panel with a one-time code that we e-mail you. You describe the change to the AI assistant in a chat, and can add photos. You review the request, start it, and get a preview when it's ready. Nothing goes live until you click Publish.
- Publish means you accept. Clicking Publish means you accept the change as the preview shows it. AI can make mistakes, so check the preview carefully before you publish.
- Our mistakes. If a change you published contains a mistake we introduced, tell us within 14 days of publishing and we fix it free of charge. Fixing our own mistake never counts towards fair use.
- Restoring. You can restore any version published in the last 3 months from your panel.
- Included. Changes to your existing pages: texts, opening hours, photos, prices, contact details, team members, services and more. The full list is on our page What counts as a change.
- Handled by our team. New pages, changes to the navigation or layout, and third-party integrations such as widgets or tracking codes: ask for them through your panel and our team gets back to you. We decide whether and how we can carry them out.
- Not offered. Redesigns and new features, such as booking systems, online shops or custom forms.
- Fair use. Changes are included under fair use, one request at a time. Your panel shows the AI cost of each request. We don't publish a fixed limit; if your use is far above what is reasonable for the plan, we tell you in advance.
- Above fair use. If your use stays far above what is reasonable after we have told you, we may pause new change requests until your next renewal date. For abuse or persistent unfair use, section 4 applies.
- About the AI. Changes are prepared by AI models from an EU-based provider (currently Mistral AI, through its EU service) and checked by automated rules before you see them. The assistant edits your website's texts and photos, not its code or design. What you send us is used only to make the changes you ask for, never to train AI models.
- Your team. Several people from your business can use the panel, and you decide who may publish. When someone signs in from a new device, we send a notice e-mail. Whatever someone with publish permission publishes counts as approved by you.
- Our credit. Every website carries a small “Made with ♥ by Backend Lab” link in its footer. It stays there: it may not be removed or hidden.
6. What stays your responsibility
- Your domain name stays registered in your name, with your own registrar. You keep it renewed, and you set the A and AAAA records we give you for your domain and its www. We don't sell domains.
- E-mail. We don't host e-mail. Your mailboxes stay with your own provider; if they come with your old hosting package, keep that package or move your e-mail before you cancel it.
- Your content. You are responsible for everything on your website and everything you send us — texts, photos, logos, videos, prices and claims — including texts the assistant wrote at your request, once you have published them.
- Rights and consents. For everything you send us, you confirm that you may use it and that it is correct: you hold the copyright or a licence for the photos, images, logos, videos and texts (including stock material you didn't make yourself), you respect other people's trademarks, you have the consent of the people shown in your photos, and your claims about health, prices and results are true and allowed. We don't check whether you hold these rights.
- What we don't publish. Content that is illegal, infringes someone else's rights, is misleading, hateful or discriminatory, is sexually explicit, or could harm visitors (such as malware or phishing). We may refuse a request, or remove content, that breaks this.
- Claims from others. If someone holds us liable because of content you supplied or approved, you cover the damage and costs this causes us, including reasonable legal costs.
- Your website's privacy and cookies. The website is yours: it needs its own privacy statement. Our visitor statistics use no cookies, but third-party integrations you add may; your website may then need a consent banner. We're happy to help.
- Your panel. Keep sign-in codes to yourself, keep your e-mail address up to date, and tell us straight away if you think someone else has access. You decide who is on your team, and you are responsible for what they do in the panel.
7. Duration and ending
- The subscription runs per year, starting as described in section 3, and renews automatically for another year at our price at that time.
- You can cancel at any time before your next renewal date; an e-mail is enough. Your website stays online until the end of the year you paid for; we don't refund the rest of that year.
- We may also end the service with two months' notice, without giving a reason, and refund the unused months.
- If we see abuse or persistent unfair use, we may suspend or end the service at any time. We then refund the unused months and give you your data, so you can take it with you.
- When the service ends, we stop serving your website, so point your domain elsewhere before then. You can have an export of your content (texts and photos) within 30 days. After that we delete it; our backups age out within 90 days.
8. Who owns what
- Your content stays yours: the texts, photos, logos and other material you give us. You allow us to use, adapt and publish it as far as needed to run your website and make the changes you ask for.
- Texts we write for your pages, ourselves or with the AI assistant, count as your content.
- Our template, code, design system, tools and panel stay ours, and so does the design we make for your website. You may use them for your website for as long as your subscription runs; that right ends when the subscription ends.
- We may show your website in our portfolio, unless you tell us not to.
9. Personal data
When we host your website and make the changes you ask for, we process personal data on your behalf — for example people shown or named in what you send us, and your visitors' details in the access logs of the network that serves your website. We then act as your processor under the GDPR, and our processing agreement applies. We use what you send us only to carry out your changes, never to train AI models. How we handle your own details, such as your account and payments, is in our privacy statement.
10. Liability
- Our liability is limited to direct damage. For everything together, it never exceeds the amount you paid us for the service concerned in the 12 months before the damage happened: at most one year's subscription fee.
- We are not liable for indirect damage, such as lost profit or revenue, missed savings, business interruption, damage to your brand, public image or reputation, claims of your customers or other third parties, fines, or the loss of data beyond what our backups can restore.
- We work to keep your website fast and available, but we don't guarantee that it is always available or free of errors. We are not liable for the consequences of an outage, a slowdown or an error, beyond the limit above.
- We are not liable for content you supplied or approved, including a change you published after its preview, or for what follows from it. We do fix our own mistakes as described in section 5.
- We are not liable for services of others that we don't control, such as your domain registrar, your DNS host, your e-mail provider or a payment provider.
- Report damage to us in writing within 30 days of discovering it. A claim lapses 12 months after the damage happened.
- None of this limits our liability for damage caused by our intent or deliberate recklessness, or anything else the law doesn't allow us to limit.
11. Things outside our control
We are not responsible when we can't deliver because of something we can't reasonably prevent: for example outages of the internet, power, or our hosting or AI providers, problems at other suppliers, cyber attacks, or government measures. If it lasts longer than 60 days, either of us may end the service, and we refund the unused months.
12. Changes to these terms
We may change these terms. We announce changes at least 30 days before they apply. If you don't agree, you may end the service from the day they take effect, and we refund the unused months.
13. Law and disputes
Dutch law applies. We first try to solve any disagreement together. If that fails, the competent court in the district where Backend Lab is established decides — unless you are a consumer and the law gives you another choice. If a part of these terms is not valid, the rest still applies.
